为了预防新型冠状病毒的传播,马来西亚政府于18.3.2020 实行了行动管制令 (Movement Control Order) 。 在这个期间里,许多的已离婚父母也相对提出了关于在这个期间探望孩子的一系列疑虑和问题,主要原因是因为有关当局并没有提供任何的相关指导方针。除了有关于探望权的问题,最近关于家暴的报导也在这个期间内迅速攀升。 决定实施行动管制令的政策是前所未有的。这项政策不仅让许多家庭及各界人士的日常生活及起居都受到了影响,而这也间接性的导致了许多离异夫妻及家庭成员之间的矛盾与争吵。 我们在这里准备了一系列的常见问答题,以帮助大家能够解决一些在这个期间所面临的问题。我们在这里也特别强调我们所提供的只是一般性的意见,因为每个家庭都拥有不同的特殊情况及案例,所以我们的答案也会更据不同的情况而有所改变。 A. 行动管制令期间的探望权 行动管制令的期间我能不能够实行我的探望权或探望孩子? 在行动管制令一开始的时候,只要一方探望孩子的时候并不是需要被另一方监督或并不需要在公共场合进行的话,探望孩子是不被禁止的。 可是,因为近期的行动管制令阻止了一切的跨州行动及禁止人民在离家超过10公里以外的范围活动的关系,面对面的探望可能已不是一个可行的选项。 除此之外,一些地方也面临了全面封锁,也就是没人能够进出被封锁的住宅区,进而导致了面对面的探望是几乎不可能的事情。因此,面对面的探望只能够在有限的情况下才能进行,例如您的前配偶住的与您非常靠近。 如果我在行动管制令的期间无法实行我的探望权,我应该怎么做? 如果您无法在行动管制令的期间实行您的探望权的话,我们建议您和另一方进行适当的沟通来讨论如何更改您的探望时间或是在行动管制令结束后才补偿这期间的探望时间。而拥有孩子抚养权的一方也应该给予适当的配合,而不是只选择顾及自己的利益。 除此之外,您也可以要求进行其他方式的探望,例如和孩子更加频繁的通话或是视讯通话一直到行动管制令结束为止。同样的,拥有孩子抚养权的一方也应该鼓励或帮助另一方执行此类的探望。双方都应该时刻的将孩子的利益作为双方的第一考量,并且避免任何企图阻止另一方的探望权又或是拥有特意疏远孩子和另一方的关系的行为。与其如此,鼓励及帮助对方以线上的方式,例如使用skype, facetime,whatsapp 视频通讯等等来和孩子联络才是正确的行为。 B. 赡养费的偿还 最近因为财务上的问题,例如公司扣除薪水的缘故,我已没有办法偿还全额的赡养费给我的前妻。在这种情况下,我能不能够减少我每个月必须要偿还的数额? 除了在您获取了法庭的庭令来改变您每月必须偿还的赡养费的数目的情况下,私自减少赡养费的数额是不被允许的。您的前妻还是拥有权力去使用庭令来向您采取一系列的法律行动,例如扣押您去监牢又或是宣告您破产的程序等等来强制您按照现有的庭令去偿还赡养费。 虽然如此,我们还是建议您先和另一方沟通或索取对方的同意去暂时性的减少您的赡养费,一直到现有的状况恢复为止。如果对方同意如此的安排的话,建议您必须记录下来及进行书面确认,以防止任何未来不必要的纠纷。如果双方无法达成协议的话,您也可以考虑向法庭申请去改变您每月必须偿还的赡养费的数目。在此建议您去向律师寻求相关的法律质询。 C. 家庭暴力 我的配偶最近经常对我使用语言上的威胁,请问我的这种情况是在家暴法律 (Domestic Violence Act 1994)的庇护之下的吗? 是的。 根据马来西亚的家暴法律,既是 Domestic Violence Act 1994之下,家庭暴力包含了以下的情况: 蓄意或故意导致或促使受害者蒙受任何的惊吓或肢体上的伤害; 在完全了解自己的动作会导致任何肢体上的伤害的情况下造成受害者承受肢体上的受伤; 通过威胁的方式来逼迫受害者去进行任何的动作,包括但并不限于任何受害者有权利拒绝的性爱行为或动作 违背受害者的意愿去拘留,扣留,或囚禁受害者 企图性或没有企图性的怀着能够引起受害者苦恼或焦虑的骚扰或破坏任何的物件 拿走或擅自扣留任何属于受害者的物品而导致受害则遭受迫害或金钱上的损失 在企图导致受害者害怕自己或第三者的安全情况下威胁受害者或导致受害者遭受苦恼 企图导致受害者的名誉受损的情况下以任何方式向受害者或第三者进行沟通,不限于电子通讯 根据马来西亚的家暴法律,既是 Domestic Violence Act 1994之下,我的孩子和父母是受到法律保护的吗? 是的。 以下是受到Domestic Violence Act…
